En la mayoría de ellas no se han producido modificaciones significativas en su esquema institucional básico y sin embargo, desde el último ciclo electoral, el cambio en el sistema de partidos ha originado una nueva dinámica política que contrapesa las tendencias «presidencialistas» y que está produciendo un fenómeno de «reparlamentarización» de la forma de gobierno. En la Comunidad Autónoma de Castilla y León, este fenómeno se entrecruza con un frustrado proceso de reforma estatutaria y un ambiguo e insuficiente proceso de mejora de la calidad democrática de su sistema representativo que sin embargo puede afectar en algún aspecto a la forma de gobierno. [EN] The constitutional concept of the form of government, thanks to its conceptual complexity, it’s useful to analyses the evolution of the balance of powers in the in the infra state level of government in the decentralized Spanish’s political system. Most of the Comunidades Autónomas haven’t adopted significant modifications in its basic institutional frameworks and, however, from the last electoral cycle, the change of the party system has produced a new political dynamic balancing the presidential trends and enforcing parliamentarism. In Castilla y León, this phenomenon get cross with a frustrated process of statutary reform and an ambiguous and not enough process of improvement democratic quality of representative system, that, however, could affect in any way to the form of government.

Respecto al censo, se destaca como objetivo último de la reforma la lucha contra el fraude en la inscripción censal. La concreta solución adoptada se considera no obstante una propuesta técnicamente mal articulada, que por otra parte no regula con clari-dad elementos importantes del sistema ni aborda los aspectos centrales más necesitados de reforma en este campo. Se realiza también en el trabajo una valoración de la situación actual de nuestro “derecho de campaña electoral” y de las causas que le han llevado a ser uno de los aspectos más necesitados de una reconsideración general dentro de nuestro derecho electoral, objetivo que no se logra con las reformas parciales contempladas en la Proposición de Ley. En este marco, se analizan las innovaciones propuestas en materia de publicidad ins-titucional, y que implican una solución legislativa prudente, pero probablemente insuficiente, para acabar con las disfuncionalidades producidas por las malas prácticas políticas en este campo. [EN] The present article analyzes the modifications to the electoral register and regulation of the electoral cam-paign, particularly focusing on institutional advertising, as mentioned in the Draft on reforming the Organic Law on the Electoral System, which is under the parliamentary consideration at present. With regard to the electoral register, the aim of the reform is the fight against fraud in the inscription. However, the solution adopted is assessed as a badly articulated proposal, which neither establishes a clear regulation on the most important elements of the system nor deals with the basic aspects most in need of reform in this field. This paper also examines the current situation of the Spanish regulation of electoral campaigning and the reasons making it one of the aspects requiring some fundamental reconsideration in our Election Law. This is not at-tained by means of the partial reforms included in the aforementioned Draft. In this context, this piece of work analyses the proposed reforms on institutional advertising, which imply a reasonable but probably insuf-ficient legislative solution, and concludes with the problems that stem from bad political habits in this área.

Existe en la doctrina una conciencia general sobre la oportunidad de repensar los presupuestos y fundamentos del Derecho constitucional. El autor defiende en este trabajo que se hace nece saria una Teoría de la Constitución que sea consciente de los cambios en el contexto filosófico, teórico y sociopolítico actual, y que evite que las reflexiones fundamentales del constitucionalismo se vacíen en teorías filosóficas de la justicia o de la comunicación y en teorías sociológicas del derecho, que puedan conducir a una desvalorización de la fuerza normativa y ordenadora del texto constitucional. Tres son los grandes rasgos que han de individualizar la reflexión sobre la Teoría de la Constitución: la existencia de un ambiente cultural que cambia paulatinamente, la evolución o transformación de las funciones del Estado y la necesidad de acometer una visión crítica de la Teoría de la Constitución asumiendo la variedad de métodos, objetivos y presupuestos conceptuales.
[EN] The current European publicist literature is experiencing a revival of the Constitutional Theory. The large majority of the doctrine shares the view that this is a good opportunity to rethink the assumptions and fundamentals of Constitutional Law. The author defends in this paper that it is necessary for the Constitutional Theory to be aware of the changes arising at the philosophical, theoretical and sociopolitical level and therefore that avoids that the fundamental thoughts of the constitutionalism could create a context in which the normative and structural power of the Constitution would be undermined by philosophical theories, justice or legal sociology approaches that do not take into account the current social developments. There are three aspects that any analysis should take into account: the existence of a cultural context that changes constantly, the evolution of the State tasks (and powers) and the need to develop a critical approach of the Constitutional Theory that do take into account the numerous methodologies, objectives and foundations of the legal theory.

Notwithstanding the fact that it was warmly welcomed by a large number of political actors, the reform was gradually demoted in the political sphere after popular protests erupted in the country in February 2011 in the context of the Arab Spring. From that time onwards, the king became the unique driving force behind the reform of the regional administration, using it to stall further negotiations on Western Sahara and to strengthen and normalize Morocco’s control over the territory. This chapter explores the impact that advanced regionalization could have on the resolution of the Western Sahara conflict and the way in which it has been a political instrument for the Moroccan state to reinforce its position in the dispute.

Using Arab Barometer data from 38 surveys in fourteen nations (2006–2016), we find that perceived corruption control, freer elections, and satisfaction with the nondemocratic government are positively related to support for democracy. To explain this link, we draw on literature that suggests that perceived corruption undermines regime legitimacy and fosters ambivalence about whether transparency would improve if free elections were implemented. Receiving clientelistic services does not impact support for democracy, suggesting that it functions as a form of system performance

the landscape of the new elites that emerged during the reign of Mohammed VI through what has been
termed associative clientelism, the limits of this new model of inclusion and the decline of these elites.

This study examines cases C-104/16 P and C-266/16 concerning, respectively, the Agricultural Agreement and the Fisheries Partnership Agreement between the EU and the Kingdom of Morocco, both of which have revealed a tug-of-war between the judiciary and the legislative and executive powers of the EU regarding the Western Sahara conflict. While the highest European legal authority stated that Western Sahara has a separate and distinct status from Morocco, the Parliament, Commission, and Council have persisted in their long-standing position of viewing the conflict as a result of postcolonial relations between France and Spain, on the one hand, and the Alawite kingdom, on the other. This article analyses the two cases at both the procedural and political levels, in addition to their consequences with regard to the positioning of the actors involved to show that, in the case of the Western Sahara conflict, EU economic and geopolitical interests have prevailed over the application of European and international law.

By focusing on the structural causes that affected this mobilization at the local level, the sectors of the population that participated in it, and the framework of the demands expressed during the protest cycle, this study finds that not only the economic constraints, but also the peripheral situation of the region and its weak integration into the structure of the state constitute explicative factors of the outbreak of this revolt in the Rif. [ES] Este artículo analiza el origen, evolución y consecuencias de la revuelta de 1984 en el Rif, particularmente en la provincia de Nador, situada en el norte de Marruecos. Para ello se presta atención tanto a las causas estructurales que afectaron a esta movilización a nivel local, como a los sectores de la población que participaron en ella y al marco de las reivindicaciones expresadas durante el ciclo de protesta. En el estudio se constata que las limitaciones económicas, la situación periférica de la región y su débil integración en la estructura del Estado constituyen factores explicativos del estallido de esta revuelta en el Rif.

No obstante, el foco en los programas políticos no ha sido un tema central para los estudios de la competición electoral. El objetivo de este trabajo es demostrar que es posible identificar empíricamente una diferenciación programática entre los principales competidores en las elecciones presidenciales de Argentina (2019), Brasil (2018) y Chile (2017), en los índices de conflicto político ideológico, socioeconómico y sociocultural; y, además, que esta diferenciación fue la que determinó los resultados electorales en los tres comicios estudiados.
[EN] Electoral competition has always generated different works about the configuration of political representation or the atti-
tudes of the citizenship concerning to the electoral context from different views. However, the focus on political programs has
not been a key issue for studies of electoral competition. The aim of this paper is to demonstrate that it is possible to empiri-
cally identify a programmatic differentiation between the main competitors in the presidential elections in Argentina (2019),
Brazil (2018) and Chile (2017), in the following indicators: ideological, socio-economic and socio-cultural political conflict.
Furthermore, we show that this differentiation was determinant over the electoral results in the three elections studied.

En Europa, la Gran Recesión, afrontar las dificultades económicas, aplicar las políticas de austeridad, y las repercusiones sociales que se derivan, ha traído consigo la trasformación de los sistemas de partidos. Este trabajo se orienta
a analizar de manera descriptiva el grado en el que los sistemas de partidos están cambiando en el periodo de la Gran Recesión, prestando atención a diferentes componentes de la volatilidad para definir hacia qué tipo de partidos políticos se está desplazando el voto y de esta manera saber hasta qué punto está amenazada la estabilidad de los sistemas de partidos en Irlanda, Portugal y España. Las principales conclusiones apuntan que mientras los sistemas de partidos se han desestabilizado especialmente en España y en menor medida en Irlanda, esta tendencia no se advierte en Portugal, donde se observa una
estabilidad sorprendente en el sistema de partidos.
[EN] The contexts of severe economic recession usually change the structure of the political window of opportunity of party systems. In Europe, the Great Recession, what mean facing economic difficulties, applying austerity policies, and deal with the resulting social repercussions, has brought about the transformation of party systems. This work is aimed at descriptively analyzing the degree to which party systems are changing in the period of the Great Recession, paying attention to different components of volatility to define towards what type of political parties the vote is moving and to what extent the stability of the party systems in Ireland, Portugal and Spain is threatened. The main conclusions point out that while party systems have been destabilized especially in Spain and to a lesser extent in Ireland, this trend is not observed in Portugal, where there is surprising stability in the party system.
