Estructura institucional e inestabilidad en las Cortes Latinoamericanas

Abstract

[ES] Este trabajo analiza el diseño constitucional referido a los poderes, composición, procedimientos de selección y duración del mandato de las Cortes Supremas y Tribunales Constitucionales en 17 países latinoamericanos entre 1900 y 2009. A partir de esta información, el trabajo muestra en qué medida la estabilidad en el cargo de los magistrados y magistradas latinoamericanos puede explicarse en función de las condiciones institucionales que regulan el sistema judicial. Nuestro análisis destaca que la supervivencia de los magistrados está determinada por la estabilidad del marco institucional, más que por su contenido jurídico específico.

[EN] This paper analyzes constitutionally-established procedures for the selection and the removal of justices, the duration of their terms, and the powers of judicial review for Supreme Courts and Constitutional Tribunals in 17 Latin American countries between 1900 and 2009. Based on this information, we assess to what extent the stability in office of Latin American justices can be explained by institutional variables. Our analysis shows that the stability of the institutional framework, more than the specific content of the constitution, explains the survival of justices in office
