Elementos económicos y constitucionales en el análisis de la asistencia jurídica gratuita

Abstract

[ES] En cuanto a la estructura, esta tesis se compone de cuatro capítulos. En el primer capítulo se identifica el proceso evolutivo de la asistencia jurídica gratuita que va desde su conceptualización como un derecho a cargo del Estado y, en concreto, desde una perspectiva favorable a su prestación, hasta el cuestionamiento del papel del Estado como mecanismo corrector del mercado a través de su función redistributiva. En el segundo capítulo se establecen los conceptos básicos que sirven de guía para el análisis de la asistencia jurídica gratuita. El tercer capítulo se establecen las principales deficiencias del mercado que obstaculizan el acceso a la justicia y que, por ende, permiten concebir a la asistencia jurídica gratuita como un mecanismo corrector de las mismas. El último capítulo de la tesis hace referencia a la dimensión constitucional de la asistencia jurídica gratuita.

[EN] In terms of structure, this thesis consists of four chapters. In the first chapter identifies the evolutionary process of legal aid that goes from its conceptualization as a right by the State and, specifically, from the standpoint of its delivery to the questioning of the role of the state's corrective mechanism market through its redistributive function. In the second chapter provides the basic concepts that guide the analysis of legal aid. The third chapter sets out the key market failures that impede access to justice and that, therefore, allows conceiving of legal aid as a mechanism for correcting them. The last chapter of the thesis refers to the constitutional dimension of legal aid.
