Prueba indiciaria y presunción de inocencia en el proceso penal

Abstract

[ES] La tesis comprende tres capítulos, dentro de los cuales, el primero se dedica al estudio de la prueba indiciaria en el marco de la teoría general de la actividad probatoria; el segundo, por su parte, se dirige a identificar los elementos concretos que permiten afirmar la compatibilidad de la prueba indiciaria y el derecho a la presunción de inocencia en el proceso penal; y, por último, el tercero conlleva el análisis sobre las vías específicas que posibilitan el control de la prueba indiciaria, como mecanismo eficaz para asegurar la tutela del referido derecho fundamental.

[EN] The thesis comprises three chapters, in which the first is devoted to the study of circumstantial evidence under the general theory of evidential activity, the second, meanwhile, is aimed at identifying specific elements that allow us to state the compatibility of circumstantial evidence and the right to presumption of innocence in criminal proceedings, and, finally, the third involves the analysis of specific pathways that allow the control of circumstantial evidence, as an effective mechanism to ensure the protection of referred fundamental right.
