A criminalização da juventude pobre no Brasil e a ascensão de um Estado de Direito Penal Máximo

Abstract

[ES]La presente investigación examina cómo la criminalización de la pobreza ocurre en Brasil y las razones de este fenómeno, sobre todo cuando se trata de la los jóvenes marginados. Por lo tanto, se trata de verificar el proceso de criminalización de este colectivo, como la propuesta de una solución para el desafío que representa una estructura de Estado que no permite la equiparación de la dinámica social y económica, y mucho menos la inclusión de todos los ciudadanos dentro de la dinámica social. Por lo tanto, esta estructura adopta encarcelamiento como la solución más eficaz para hacer frente a los rechazados socialmente que flota alrededor de los otros ciudadanos y sus asuntos diarios. La hipótesis planteada es que la criminalización de la pobreza es una opción de castigo en la justicia especializada para los menores de edad, siendo no sólo la criminalización de la juventud, sino también la búsqueda de las raíces más profundas de imponer la estigma penal a los menores y hacerse cargo de conducir a esa marginación con la misión de purgar a los socialmente rechazados.

[EN]The present dissertation is devoted to examining how the criminalization of poverty occurs in Brazil and the reasons of this phenomenon, especially when it comes to the marginalized youth. Thus, it seeks to verify the criminalization process of this collective, as well as a solution to the challenge posed by a State structure that does not allow the equalization of the social and economic dynamics and even less the inclusion of all citizens within the social dynamic. Thus, this structure adopts incarceration as the most effective solution to cope with the socially rejected that floats around the other citizens and their daily affairs. The hypothesis presented on the criminalization of the poverty argues that this strategy shows already as a punitive option in justice specialized for minors, being not only the criminalization targeted to the youth but also searching for deeper roots to impose the criminal stigma to underage individuals and to take charge to drive the marginalized to an underclass status. Concomitantly with the emptying and abandonment of the guidelines of a State of Social-Welfare, it can be perceived that a Penologist State is launched and gain force, with the mission to purge the socially rejected as a result of neo-liberalism and consumption society.
