La protección del menor de edad en el ámbito sanitario respecto al consentimiento informado: ¿paternalismo o proteccionismo?

Abstract

[ES] El menor de edad, al no poseer plena capacidad de obrar, requiere una especial protección por parte del ordenamiento jurídico. Esta protección se extiende al ámbito sanitario, y afecta especialmente a la regulación del consentimiento informado, que constituye un pilar básico de la relación entre el facultativo y el paciente. Determinar cuándo el paciente menor de edad puede prestar consentimiento o cuando deben otorgarlo por él sus representantes legales es un tema que provoca debate. La reforma del art. 9 de la Ley 41/2002 de Autonomía del Paciente por la Ley 26/2015, restringió la capacidad del menor para prestar el consentimiento médico y dio mayor relevancia a criterios como la madurez del menor o su capacidad de comprensión para valorar el alcance y los riesgos de las actuaciones sanitarias, así como a la necesidad de proteger la vida y la salud del menor, especialmente en situaciones de grave riesgo. En este trabajo se analiza si las modificaciones introducidas por la Ley 26/2015, para valorar si responden a una perspectiva demasiado paternalista en cuanto a la capacidad que se reconoce al menor para decidir respecto sobre su salud, o si reflejan una concepción protectora adecuada y necesaria para hacer realidad el principio del interés superior del paciente menor de edad, especialmente en supuestos de grave riesgo para su salud.

[EN] Being underage means not having full capacity to act, so they have special protection in the legal system. This protection extends to the health field, and especially affects the regulation of informed consent, which is a basic pillar of the relationship between the doctor and the patient. Determining when the minor patient cant give cconsent or when his legal representatives must gives it for him, is a subject that provokes debate. The reform of article 9 of Law 41/2002 on Patient Autonomy by Law 26/2015, restricted the child's ability to give medical consent, and gave greater relevance to criteria such as the maturity of the minor or his ability to understand to assess the scope and risks of health actions, as well as the need to protect the life and the health of the minor, especially in situations of serious risk. This work analyzes whether the modifications introduced bu the Law 26/2015, to assess whethet ir responds to a too paternalistic perspective regarding the child’s recognized ability to decide regarding his health, or if, it is considered an adequate and necessary protective conception to realice the principle of the best interest of the minor patient, especially in cases of serious risk to your health.
