La dignidad humana y los derechos sociales

Abstract

This article analyzes the legal concept of human dignity, starting from its moral, ethical notion. Dignity is the source and origin of all human rights, it is a special quality that corresponds to each person and therefore it must always be linked to the principles of justice and equality. Human dignity is the requirement that makes civil and political rights as well as property rights human rights. The legal support of human dignity must be the priority of a social and democratic State, which must make effective the coverage of a vital minimum, the inviolable core of social rights. Citizens must improve their living conditions, achieve human dignity, through the activity of the Administration, since that activity is what constitutionally justifies it.

En este artículo se analiza el concepto jurídico de dignidad humana, partiendo de su noción moral, ética. La dignidad es la fuente y el origen de todos los derechos humanos, es una cualidad especial que corresponde a cada persona, por ello siempre debe ir unida a los principios de justicia e igualdad. La dignidad humana es la exigencia que hace que tanto los derechos civiles y políticos como los prestacionales sean derechos humanos. El respaldo legal de la dignidad humana debe ser la prioridad de un Estado social y democrático, que debe hacer efectiva la cobertura de un mínimo vital, el núcleo inviolable de los derechos sociales. Los ciudadanos deben mejorar sus condiciones de vida, alcanzar la dignidad humana, a través de la actividad de la Administración, ya que esa actividad es la que la justifica constitucionalmente.
