Acceso a la justicia para las mujeres víctimas de violencia de género: un reto para el poder judicial salvadoreño

Abstract

This research contains an analysis that links gender studies and the administration of justice in El Salvador. It presents a socio-legal problem on the barriers in access to justice for women victims of gender violence, focusing on the fundamental rights of women in the course and resolution of judicial processes. It is argued that the legal methodology of gender analysis, as an effective tool to impart justice in light of international and constitutional standards on human rights and application of the principle of equality. Producing this study within the framework of the doctoral training of this author. This problem is addressed from the science of law, based on doctrinal, jurisprudential and legislative sources on human rights./nThis research presents the fundamental argument of considering a legal figure that unifies the incorporation of gender throughout the judicial process, from the classification of the crime, the assessment of the evidence and the judicial ruling and thus give greater certainty and legal certainty to women on an equal footing with men. The study concludes by proposing some basic criteria for the implementation of the gender perspective in the administration of justice.

/nTo support positions in this article, the reality in which the author works is analyzed: El Salvador. But the good practices of applying justice in other legal contexts are also taken up, such as Mexico, Chile, Guatemala and Nicaragua. So that they can be taken up again to guarantee the due process of women's rights towards an egalitarian society where law and justice serve as instruments of peace for the construction of a culture of legality and protection of the rights of human beings. Pretending to enhance the role of the judiciary with the use of gender analysis as a tool to administer justice in light of international legal standards on Human Rights.

Esta investigación contiene un análisis que vincula estudios de género y administración de justicia en El Salvador. Presenta un problema sociojurídico sobre las barreras en el acceso a la justicia para las mujeres víctimas de violencia de género, enfocándose en los derechos fundamentales de la mujer en el curso y resolución de procesos judiciales. Se sostiene la metodología jurídica de análisis de género, en cuanto herramienta eficaz para impartir justicia a la luz de estándares internacionales y constitucionales sobre derechos humanos y aplicación del principio de igualdad. Produciendo este estudio en el marco de la formación Doctoral de esta autora. Se aborda esta problemática desde la ciencia del derecho, apoyándose en fuentes doctrinales, jurisprudenciales y legislativas en materia de derechos humanos./nSe presenta en esta investigación el argumento fundamental de considerar una figura legal que unifique la incorporación del género en todo el proceso judicial, desde la calificación del delito, la valoración de la prueba y el fallo judicial y así dar mayor certeza y seguridad jurídica a las mujeres al pie de igualdad que los hombres.

/nEl estudio concluye proponiendo algunos criterios básicos para la implementación de la perspectiva de género en la administración de justicia.

/nPara sustentar posiciones en este artículo, se analiza la realidad en la que la autora se desempeña: El Salvador. Pero también se retoman las buenas prácticas de aplicación de justicia en otros contextos legales como México, Chile, Guatemala y Nicaragua. Para que puedan ser retomadas para garantizar el debido proceso de los derechos de las mujeres hacia una sociedad igualitaria en donde el derecho y la justicia sirvan como instrumentos de paz para la construcción de una cultura de legalidad y de protección de los derechos de los seres humanos. Pretendiendo enaltecer el rol de la judicatura con la utilización del análisis de género como herramienta para administrar justicia a la luz de estándares jurídicos internacionales sobre los derechos humanos.
