Resumen de tesis. Libertad de expresión en internet, aspectos éticos y legales

Abstract

[ES]La presente investigación, nacida a partir de la necesidad de optimizar la sociedad contemporánea en razón de los cambios sociológicos provocados por la red mundial de computadores, busca desarrollar, bajo los aspectos éticos y legales, la libertad de expresión en la internet y los inevitables conflictos con otros derechos igualmente fundamentales. Para tanto, analiza las decisiones de las principales Cortes de Justicia de Europa y de los Estados Unidos de América. Se da énfasis a las “fake news” y la influencia que ellas provocan en el debate público y, por consiguiente, en el proceso democrático, apuntado los posibles caminos para solucionarlas, como la regulación o no, y la aplicación del Mandamiento del Equilibrio Fluido Equidistante, y el rol que cabe a la Jurisdicción Constitucional Brasileña. [EN]This investigation, born from the need of optimizing the contemporary society in the reason of the sociological changes provoked by the worldwide web of computers aims to develop, under ethic and legal aspects, the freedom of expression on the internet and the unavoidable conflicts with other rights who are equally fundamental. For this, it analyzes the decisions of the most important Judicial Courts from Europe and The United States. The emphasis is given to “fake news” and the influence which they provoke in the public debate and, therefore, in the democratic process, by pointing the possible ways to solve them, as the regulation or not, and the application of the Commandment of Equidistant Fluid Balance, and the roll which is up to the Brazilian Constitutional Jurisdiction.
