La ratificación por España del Protocolo a la Carta Social Europa sobre reclamaciones colectivas

Abstract

[ES] Aborda este estudio la reciente ratificación por España del Protocolo adicional a la Carta Social Europea sobre reclamaciones colectivas, empezando por el origen político supranacional de ese tratado internacional del sistema de derechos humanos del Consejo de Europa, marcado por la asimetría entre los derechos civiles y políticos de un lado y los derechos sociales de otro lado. Y continuando con la controvertida base política e ideológica de la incorporación al Derecho español de ese tratado internacional, junto a la ratificación de la Carta Social Europea revisada. Asimismo, constituye un contenido central de este trabajo el régimen jurídico del sistema de reclamaciones colectivas, con especial atención a la doctrina procedimental emanada por el órgano de garantía y control de la Carta Social Europea (original o revisada), el Comité Europeo de Derechos Sociales. Y se cierra el trabajo con una relación de las más recientes resoluciones del citado órgano de garantía producto de reclamaciones colectivas. Con carácter previo, se ofrece una aproximación a la contribución del sistema de reclamaciones colectivas asumido por Espala a la protección multinivel de los derechos fundamentales laborales.

[EN] This study addresses the recent ratification by Spain of the Additional Protocol to the European Social Charter on collective claims, starting with the supranational political origin of this international treaty of the Council of Europe human rights system, marked by the asymmetry between civil rights and politicians, on one side and social rights on the other side. And continuing with the controversial political and ideological basis of the incorporation into Spanish law of that international treaty, together with the ratification of the revised European Social Charter. Likewise, the legal regime of the collective claimssystem constitutes a central content of this work, with special attention to the procedural doctrine issued by the guarantee and control body of the European Social Charter (original or revised), the European Committee of Social Rights. Finally this article lists the most recent resolutions of the aforementioned guarantee body product of collective claims. Previously, an approach is offered to the contribution of the collective claims system, assumed by Spain to the multilevel protection of fundamental labor rights.
