El incremento del salario mínimo interprofesional. La incidencia en la negociación colectiva y en la gestión empresarial de la retribución

Abstract

[ES]La notable y sostenida subida del salario mínimo interprofesional (SMI) de los últimos años plantea a la negociación colectiva y a las empresas unos problemas y unos retos jurídicos distintos a los del pasado. Además del análisis teórico y práctico de los problemas y de los retos jurídicos, se ofrece en este estudio una apuesta por la negociación colectiva como instrumento de seguridad jurídica donde la inseguridad viene campando a sus anchas, así como por el replanteamiento del marco jurídico en el que se desenvuelve la incidencia del incremento anual del SMI en la negociación colectiva y en la obligación empresarial de pago del salario, muy en particular de la regulación (legal, reglamentaria y convencional) de la absorción o compensación del incremento anual del SMI, sin duda, el principal de los problemas y retos jurídicos tratados en este trabajo. El previsible incremento del SMI durante los próximos años, la próxima intervención del Tribunal Supremo para poner orden en esta judicialmente desordenada materia y el debate europeo sobre los salarios mínimos adecuados a buen seguro contribuirán a mantener el protagonismo asumido por la temática objeto de este estudio.

[EN]The notable and sustained rise in the minimum interprofessional wage in recent years causes problems and legal challenges for collective bargaining and employers that are different from those of the past. In addition to the theoretical and practical analysis of the legal problems and challenges, this study offers a commitment to collective bargaining as an instrument of legal security where insecurity has been rampant, as well as the rethinking of the legal framework in the that the incidence of the annual increase in the minimum interprofessional wage unfolds in collective bargaining and in the business obligation to pay wages, particularly in the regulation (legal, regulatory and conventional) of the absorption or compensation of the annual increase in the minimum interprofessional wage, without a doubt the main one of the legal problems and challenges dealt with in this work. The foreseeable increase in the minimum interprofessional wage over the next few years, the forthcoming intervention of the Supreme Court to put order in this judicially disorderly matter, and the European debate on adequate minimum wages will surely contribute to maintaining the prominence assumed by the subject matter of this work.
