Las expectativas del consumidor en los criterios de conformidad del TRLGDCU y CCCAT

Abstract

[ES] Los criterios objetivos de conformidad están basados en las características y fines que presentan normalmente los bienes y los contenidos y servicios digitales del mismo tipo y en las expectativas razonables del consumidor. En el presente trabajo estudiamos, por una parte, los criterios objetivos de conformidad en el Texto Refundido de la Ley General de Consumidores y Usuarios y en el Código civil de Cataluña, y, por otra parte, las expectativas del consumidor, en concreto desde el prisma del estándar de la razonabilidad y los elementos de evaluación que permiten su delimitación. [EN] The objective requirements for conformity are based on the characteristics and purposes that goods and digital content and services of the same type normally have and on the reasonable expectations of the consumer. The objective of this work is to study, on the one hand, the objective criteria of conformity in the TRLGDCU and in the Civil Code of Catalonia, and on the other hand, the consumer expectations, specifically in the light of the standard of reasonableness and the assessment elements that grant its delimitation.
