La crítica de Hans Kelsen a las concepciones metafísicas de la justicia

Abstract

[ES] Como positivista y relativista en una doble vertiente ética y epistemológica, Hans Kelsen se enfrentó a cualquier tentativa de determinar el significado de la justicia por cauces tanto racionales como metafísicos. Su adhesión a una epistemología relativista-crítica, según la cual los objetos «en sí» son inaccesibles al entendimiento humano, le impulsó a tratar de desbaratar el enfoque metafísico de las doctrinas que él denomina «absolutistas». Con ese objetivo polemiza sobre todo con Platón, en cuya doctrina de las ideas, y en su especulación sobre la idea del bien, ve el arquetipo del absolutismo moral. Pero también criticó los principios de justicia que se contienen en las Sagradas Escrituras, señalando algunas contradicciones entre el Antiguo y el Nuevo Testamento, y entre las enseñanzas de Jesús y las de San Pablo.

[EN]In ethical and epistemic standards, Hans Kelsen was both a positivist and a relativist. From this intellectual framework, Kelsen challenged any attempt to determine the meaning of justice through either rational or metaphysical paths. As a defender of a critical and relativistic epistemology –for which any an-sich object is inaccessible to human understanding–, he argued against the metaphysical approach of some conceptions of justice he named «absolutist» conceptions. In his view, the Platonic doctrines of the good and the ideas are both clear examples of an «absolutist» conception. However, he also criticized the ideas on justice scattered throughout the Holy Scriptures. He also seized the chance to unveil some contradictions between Old and New Testament and the teachings of Jesus & St. Paul.
