Los excesos regulatorios de la reforma de la Ley 12/2013 sobre el funcionamiento de la cadena alimentaria

Abstract

[ES] Este artículo estudia la reforma de la Ley 12/2013 para mejorar el funcionamiento de la cadena alimentaria por la que se adaptó el Derecho español a la Directiva 2019/633 sobre prácticas comerciales desleales en las relaciones comerciales de la cadena alimentaria y se introdujeron otras modificaciones en los contratos alimentarios. Aborda el análisis de la regulación de la contratación alimentaria desde la perspectiva de su incidencia en la competitividad de los operadores nacionales del sector, tanto en el mercado nacional como internacional. [EN] Spanish Law 16/2021, amending Law 12/2013 on measures to improve the functioning of the food supply chain (LCA, after its initials in Spanish), has broadened the extent of the legislator’s intervention in the agricultural and food supply chain. New statutory requirements on trade relationships between operators in the chain (or “contracts in the food supply chain”, within the meaning of the term in LCA) and the prohibition of unfair trading practices within these relationships (which include those listed in Directive 2019/633 and additional ones incorporated by the Spanish legislator) reflect an expansive vocation in this new legal framework, which broadens the subjective, objective and territorial scope of LCA.
