La persistencia del pasado autoritaroio en Chile: encrucijadas de la justicia transicional y el estallido social

Abstract

[ES] A pesar de todos sus logros, en la larga e inconclusa transición a la democracia en Chile (1990 a la fecha) todavía persisten desafíos para saldar cuentas con las secuelas sociales de la dictadura civil-militar (1973-1990). El estado de derecho y el proceso de justicia transicional se han visto problematizados con ocasión de la revuelta social de la primavera de 2019, y en particular por las masivas movilizaciones sociales y la violencia institucional en los meses del denominado “estallido social”. Por ello, esta tesis doctoral persigue comprender la persistencia del pasado traumático de la dictadura en el Chile transicional y las principales dificultades que lentamente se han ido sorteando para avanzar en las búsquedas de verdad, memoria, justicia, reparación y garantías de no repetición. Asimismo, busca analizar cómo el estallido social de 2019 está incidiendo en el curso de los procesos de transición a la democracia y justicia transicional, obligando a repensar las estrategias que son necesarias para robustecer el estado de derecho, la democracia y la vigencia de los derechos humanos en Chile. Para aproximarse a los fenómenos analizados y formular propuestas teóricas y prácticas que signifiquen contribuciones sustantivas al debate público, en las siete aportaciones que hilvanan esta tesis doctoral se combinan los métodos documental, dogmático, comparado y empírico, en los niveles micro y macro. [EN] Despite all its achievements, the long and inconclusive transition to democracy in Chile (1990 to date) still faces challenges in terms of settling accounts with the social aftermath of the civil-military dictatorship (1973-1990). The rule of law and the transitional justice process have been problematized on the occasion of the social revolt of spring 2019, and in particular by the massive social mobilizations and institutional violence in the months of the so-called “social outburst”. Therefore, this doctoral thesis seeks to understand the persistence of the traumatic past of the dictatorship in transitional Chile and the main difficulties that have slowly been overcome to advance in the search for truth, memory, justice, reparation and guarantees of non-repetition. It also seeks to analyze how the 2019 social outburst is affecting the course of the processes of transition to democracy and transitional justice, forcing to rethink the strategies that are necessary to strengthen the rule of law, democracy and the enforcement of human rights in Chile. In order to approach the phenomena analyzed and formulate theoretical and practical proposals that make substantive contributions to the public debate, the seven contributions that weave this doctoral thesis combine documentary, dogmatic, comparative and empirical methods, at the micro and macro levels.
