El alertador fiable: nueva figura incorporada por el reglamento de servicios digitales para la detección y notificación del contenido ilícito en la red

Abstract

[ES] Con la entrada en vigor del DSA, se refuerza el sistema de responsabilidad de los prestadores de servicios de plataformas digitales por el almacenamiento de contenido ilícito que suben y comparten los usuarios. La aplicación del sistema de puerto seguro se fortalece con la integración de una nueva figura denominada “alertador fiable”, un sujeto cualificado para la detección y notificación del contenido ilícito, un colaborador que permite agilizar su eliminación de la red y evitar que terceras personas puedan acceder a él. El objeto del presente trabajo es analizar el régimen jurídico del alertador fiable y exponer las ventajas y mejoras observadas en la regulación contenida en el DSA. [EN] With the DSA, the system of liability of digital platform service providers for the storage of illicit content uploaded and shared by users is reinforced. The application of the safe harbor system is strengthened with the integration of a new figure called “reliable alerter”, a qualified subject for the detection and notification of illicit content, a collaborator who makes it possible to expedite its elimination from the network and prevent third parties from being able to access it. The purpose of this work is to analyze the legal regime of the reliable whistleblower and present the advantages and improvements observed in the regulation contained in the DSA.
