El «crimigrante»: un culpable sin delito

Abstract

[ES] La asociación de términos «culpable» y «sin delito» podría parecer una contradicción. Sin embargo, el inmigrante se convierte, utilizando un juego de palabras, en un «crimigran- te», es decir, viene criminalizado, etiquetado como «delincuente» (a pesar de no haya come- tido ningún delito) y sancionado cautelarmente con la privación de libertad por haber in- cumplido la legislación administrativa relativa a la entrada y permanencia en España. Este artículo intenta ofrecer un análisis crítico del fenómeno, poniendo de manifiesto cómo la«actuación» de la sociedad y del sistema de administración de justicia es selectiva y sesgada, hasta el punto de defender intervenciones cautelares desmesuradas contra los migrantes. [EN] The association of the terms «guilty» and «no crime» might seem like a contradiction. However, the immigrant becomes, to use a play on words, a «crimigrant», that is, he or she is criminalised, labelled as a «delinquent» (even though he or she has not committed any crime) and punished with a custodial sentence or measures involving deprivation of liberty for having failed to comply with the administrative legislation on entry and stay in Spain. This paper attempts to offer a critical analysis of the phenomenon, highlighting how the «action» of society and the justice administration system is selective and biased, to the point of defending disproportionate precautionary administrative interventions against migrants.
