A Commentary on the Lounes Case and the Protection of EU Citizens’ Rights Post-Brexit

Abstract

[EN] This is a commentary on the latest contribution of the Court of Justice of the EU to the development of EU citizenship, the Lounes case. A preliminary request brought by the UK High Court concerning an amendment made to the national regulation implementing Directive 2004/38, this dual nationality case highlights the differences between EU migration law and that of the UK. In this sense, it is also indicative of what is to be expected once EU citizens’ rights are no longer protected by EU law and the Court of Justice but by the EU-UK Withdrawal Agreement after Brexit. [ES] Comentario de jurisprudencia sobre la última contribución del Tribunal de Justicia al desarrollo de la ciudadanía de la Unión, el caso Lounes. Se trata de una cuestión prejudicial planteada por la High Court de Reino Unido por la reforma de una ley de transposición de la Directiva 2004/38 en relación con la doble nacionalidad. Subraya así las diferencias entre el derecho migratorio de la UE y del RU y también es indicativo en este sentido de lo que habrá de esperarse una vez que los derechos de los ciudadanos pasen de estar protegidos por el Derecho de la Unión y el TJUE a estarlo bajo el Acuerdo de Retirada después del Brexit.
