Las propuestas de reforma del Código Civil español

Abstract

[ES] Es inevitable poner de relieve la necesidad de reformar el Código Civil español para adaptarlo a la nueva realidad social, económica y tecnológica española y, por ello, el objetivo de este trabajo es analizar las deficiencias que actualmente acumula el Código Civil español y los intentos de modernizarlo o recodificarlo. No se estudiarán las múltiples reformas que ha sufrido el texto, más de setenta, aunque incluyan la modificación de numerosos artículos, por tratarse de reformas sectoriales dirigidas a una materia concreta y no a una modernización total del Código o de alguno de sus Libros. En consecuencia, se analizarán las principales iniciativas modernizadoras de la Comisión General de Codificación y de la Asociación de Profesores de Derecho Civil. [EN] It is inevitable to highlight the need to reform the Spanish Civil Code to adapt it to the new Spanish social, economic and technological reality, and for this reason, the aim of this paper is to analyse the deficiencies currently accumulated in the Spanish Civil Code and the attempts to modernise or recodify it. The multiple reforms that the text has undergone, more than seventy, will not be studied, even though they include the modification of many articles, because they are sectorial reforms aimed at a specific matter and not at a total modernisation of the Code or of any of its Books. Consequently, the main modernising initiatives of the General Codification Commission and the Association of Civil Law Professors will be analysed.
