Principales vías de tutela frente al acoso moral en el trabajo y su problemática jurídica

Abstract

[ES] Este trabajo aborda los problemas jurídicos que plantea la ausencia de una definición legal específica y de un tratamiento normativo unitario del acoso moral. Para ello será necesario analizar sus rasgos caracterizadores y distintivos, a fin de valorar posteriormente la protección que el ordenamiento jurídico le dispensa. Pese a la importante labor constructiva llevada a cabo por la jurisprudencia de suplicación, la víctima de estas conductas se encuentra habitualmente en una difícil posición jurídica, agravada si cabe por la dificultad probatoria que caracteriza el acoso. Así pues, se aboga por los sistemas de protección efectiva frente a estas situaciones, que neutralicen y reparen el daño ocasionado, sin desatender una actuación preventiva que evite, en gran medida, acudir a las restantes vías de tutela. [EN] This work aims to explore the legal problems related with the absence of a specific legal definition and a regulated process of moral harassment. For this purpose, it will be necessary to determine and characterize the specific features associated to moral assessment in order to subsequently evaluate the protection provided by the legal system. Despite the significant efforts of jurisprudence, the victim of harassment is usually in a difficult legal position to afford significant evidences of moral harassment. Therefore, effective protection systems are considered as the suitable solution to neutralize and repair the damage, emphasizing the importance of developing prevention strategies to avoid the use of alternative legal routes.
