La Ley 23/2014 de reconocimiento mutuo de resoluciones penales en la Unión Europea

Abstract

[ES] El objetivo del presente artículo es analizar el nuevo régimen, en España, de reconocimiento mutuo de resoluciones en materia penal dentro de la Unión Europea, como resultado de la adopción de la Ley 23/2014, de 20 de noviembre, sobre esta cuestión. La mencionada Ley regula tanto las actuaciones que debe llevar a cabo nuestro país como Estado emisor al tramitar una solicitud de reconocimiento mutuo de cualquiera de los diez instrumentos incluidos en sus disposiciones, como la manera de implementar su reconocimiento o ejecución, prestando especial atención a los motivos de denegación cuando actúa como Estado ejecutor. [EN] The aim of the present paper is to analyse the new regime, in Spain, of mutual recognition of decisions on criminal matters within the European Union, as a result of the adoption of the Law 23/2014, of 20 November, regarding this question. The aforementioned Law provides the regulation of both, the actions to be carried out by our country as issuing State when delivering a request of mutual recognition of any of the ten instruments contained on its provisions, and the way to implement its recognition or execution, with special attention being devoted to the grounds for refusal, when acting as executing State.
