Los equipos conjuntos de investigación en materia penal: un instrumento de colaboración entre España y Portugal

Abstract

[EN] En el presente trabajo analizamos la regulación de los equipos conjuntos de investigación en España y Portugal a través del estudios sistemático y comparado del artículo 13 del Convenio de asistencia judicial del año 2000 y de las normativas de adaptación llevadas a cabo en estos Estados miembros, destacando la utilidad de un instrumento específico y vinculante que permite actuaciones coordinadas a través de investigaciones conjuntas que se desarrollen en el territorio de dos o más Estados y poniendo de manifiesto las carencias que puedan explicar que no se haga un mayor uso del mismo. [EN] In this work, we offer an approach to the jointstudy by the Portuguese and Spanish Legal Teams of the article 13 of the Convention on Mutual Assistance in Criminal Matters between the Member States of the European Union. Besides, we also study the adaptation of the before said article to the legal system of each EU member, highlighting the convenience of a binding and specific legal instrument, that allows joint investigations teams developed in this subject within the EU territory, as well as the legal loops that would explain andjustify a broader use of such binding legal instrument.
