La sanción de las manifestaciones del sinhogarismo en el espacio público de Castilla y León: un estudio empírico

Abstract

[ES]La sanción de las manifestaciones del sinhogarismo está en auge en el ordenamiento jurídico español, existiendo un desconocimiento empírico de su aplicación. El objetivo de la investigación es conocer si las personas en situación de sinhogarismo son castigadas por conductas que se relacionan con su situación de extrema pobreza durante su vivencia en la calle. Con este fin, se aplicó un cuestionario a 47 usuarios/as de recursos de sinhogarismo en Castilla y León. Los resultados mostraron que las personas encuestadas llevaron a cabo actividades en el espacio público contempladas como infracción, muchas de ellas para satisfacer sus necesidades básicas, aunque raramente fueron multadas por ello. Se propone replicar esta investigación a nivel nacional y reformar las leyes administrativas que sancionan las manifestaciones del sinhogarismo. [EN]The sanctioning of manifestations of homelessness is on the rise within the Spanish legal framework. However, there is a lack of empirical knowledge on its application. The objective of this research is to know whether homeless people living on the street are punished for behaviors related to their extreme poverty situation while living on the street. To this end, a questionnaire was administered to 47 people using homelessness resources in Castilla y León. The results revealed that they carried out activities in public space which are considered infringements, being many of them to fulfill their basic needs, even though they were rarely fined for this. It is proposed to replicate this research on a national level and to reform administrative sanctioning law which punishes manifestations of homelessness.
