Abstract

[ES] El TJUE avanza en el desarrollo jurisprudencial del principio de reconocimiento mutuo en las materias relacionadas con el estatuto personal. En esta ocasión, constata la necesidad de que al amparo del derecho a la libre circulación y residencia que tienen los ciudadanos de la Unión Europea (art. 21 TFUE) y sobre la base del respeto al derecho a la vida privada y familiar (art. 7 CDFUE) y la prohibición de discriminación por orientación sexual (art. 21 CDFUE), Polonia, que no reconoce el matrimonio entre personas del mismo sexo, debe permitir la transcripción del certificado matrimonial expedido por Alemania. [EN] The CJEU is advancing the case law development of the principle of mutual recognition in matters relating to personal status. In this instance, it affirms that, under the right to free movement and residence of citizens of the European Union (Article 21 TFEU) and on the basis of respect for the right to private and family life (Article 7 Charter of Fundamental Rights of the European Union) and the prohibition of discrimination on the grounds of sexual orientation (Article 21 Charter of Fundamental Rights of the European Union), Poland, which does not recognize same‐sex marriage, must allow the transcription of marriage certificates issued by Germany.
