Floridablanca y los conceptos fundamentales del Ius Gentium Europaeum

Abstract

[ES] En este artículo analizamos, en primer lugar, los conceptos o principios fundamentales del Ius Gentium Europaeum del siglo XVIII (soberanía e interés estatal, equilibrio europeo, neutralidad, línea de amistad y libertad de los mares). Estos principios, a pesar de no tener el carácter de normas jurídicas, generan unas relaciones internacionales estables porque son asumidos por la mayoría de los Estados. Asimismo demostramos que la Instrucción Reservada del conde de Floridablanca constituye una de las mejores fuentes políticas para explicar los fundamentos del orden internacional de este siglo.

[EN] In this article the autor analyses, firstly, the fundamental concepts or principles of the Ius Gentium Europaeum of the century XVIII (sovereignty and interest of state, European balance of power, neutrality, amity-line and freedom of the seas). This principles, in spite of the fact have not character of law, they generate a stable international relation because they are assumed by the majority of States. In the same way, the autor proves that the Instrucción Reservada of the count Floridablanca is one of the best political source for to explain the fundamentals of the international orden of this century.
