Los Escopeteros Voluntarios de Andalucía: fuero militar y jurisdicción militar en conflicto

Abstract

[ES] El siglo XVIII —de tan buena «imagen» historiográfica— es de hecho el periodo de la historia de España en que se crean más cuerpos y fuerzas de seguridad, reconocimiento tácito por parte de los gobernantes de los altos niveles de conflictividad soterrada. Estos cuerpos son mayoritariamente de índole militar, lo que origina con frecuencia confusiones y demandas de aclaraciones sobre su verdadera naturaleza y la jurisdicción a la que pertenecen. En teoría, los de naturaleza militar estaban regidos por las Ordenanzas Generales del Ejército, pero en la práctica esta condición no siempre fue reconocida por las autoridades civiles ni afectaba a todos sus miembros por igual, generando conflictos jurisdiccionales que exigieron una larga tramitación. En las páginas que siguen vamos a tratar uno de los más complejos de estos conflictos, relativo a los Escopeteros Voluntarios de Andalucía.

[EN] The eighteenth century —which generally enjoys such a good historical «image» — is in fact the period in which most security forces and corps were created in the history of Spain, tacit recognition that the rulers were trying to hold down the lid on a troublesome level of underlying strife. These corps were mainly military in kind, and this factor was a frequent source of confusion, leading to calls for clarification about their true nature and the jurisdiction they came under, whether civil o military. In theory, those of a military nature were ruled by the General Ordinances of the Army but in practise this condition was not always recognised by the civil authorities nor considered to apply to all their members. This gave rise to long-winded and cumbersome jurisdictional conflicts. We are going to deal in the following pages with one of the most complex examples of such conflicts that has come to light, concerning the corps called the «Escopeteros Voluntarios de Andalucía».
