El recurso a la justicia como vía de resolución de la conflictividad criminal gallega afines del Antiguo Régimen. El ejemplo de Santiago de Compostela (1700-1834)

Abstract

[ES] En el Antiguo Régimen, a pesar de los innumerables esfuerzos de la Corona, los tribunales no fueron el único lugar en donde resolver los conflictos de índole criminal y de hecho las sociedades preindustriales se mostraron reticentes a utilizarlos por considerarlos deshonrosos. Este estudio pone de manifiesto el avance en el uso de las instituciones de justicia gallegas durante el siglo XVIII, el cual, lejos de estar determinado por un aumento de la población, se vincula estrechamente con el curso de la vida económica de la Galicia atlántica. El análisis se completa con el examen de las pautas de utilización de los tribunales atendiendo al origen geográfico y al estatus socioprofesional de los demandantes así como a la materia del delito denunciado.

[EN] In the Old Regime, despite the endless efforts of the Crown, tribunals were not the only places where to solve criminal disputes and in fact, pre-industrial societies would show reticence to use them as they would find them dishonourable. This study reveals the progress in the use of the Galician judicial institutions in the 18th century. This progress, far from being determined by an increase of the population, is closely linked with the course of the economic life of the Atlantic Galicia. The analysis is added up with the exam of the guidelines of use of the tribunals according to the geographic origin and the socioprofessional status of the plaintiffs and to the matter of the reported offence.
