Extranjería e Inmigración: el derecho a la educación y a la protección de la salud

Abstract

[ES] El presente trabajo de investigación no pretende realizar un análisis completo de la totalidad de los derechos sociales que comprende la Constitución Española de 1978, sino que, únicamente se limitará al análisis de dos derechos sociales básicos que hoy en día han adquirido gran relevancia debido a su aspiración igualitaria y que indefectible por ello resultan ser necesarios con vistas al reconocimientos de los derechos sociales a los cuales también tienen derechos los extranjeros inmigrantes en España. Por ello, en el Capítulo Segundo arrancamos con una reseña acerca de la evolución histórica que han experimentado los derechos sociales, y demostraremos como aquellos derechos sociales han modificado el concepto inicial de igualdad formal que se tenía en la época del sistema liberal, evolucionando de este modo de un sistema de igualdad formal a un sistema de igualdad real que comprende e incluye en la actualidad no solo a determinados grupos de personas, sino que más bien se manifiesta incluyente respecto de la totalidad de personas que comprenden los Estados en general, ello de forma independiente de la condición de nacional o extranjero que tengan las personas dentro de los Estados. De este modo resaltaremos el ámbito de la titularidad de los nuevos sujetos sociales que son incluidos en este grupo de derechos, tomando en cuenta la diferente naturaleza jurídica que poseen los derechos sociales respecto de los derechos civiles y políticos, que tendían hacia el reconocimiento y garantía de las libertades de la persona humana dentro del Estado.

[EN] The present work of investigation does not try to realize a complete analysis of the totality of the social rights that understands the Spanish Constitution of 1978, but, only it will limit itself to the analysis of two social basic rights that nowadays have acquired great relevancy due to his igalitarian aspiration and that unfailing for it turn out to be necessary with a view to the reconocimientos of the social rights to which also they have the immigrant foreigners right in Spain. For it, in the Second Chapter we start with a review it brings over of the historical evolution that the social rights have experienced, and we will demonstrate as those social rights they have modified the initial concept of formal equality that was had in the epoch of the liberal system, evolving thus from a system of formal equality to a system of royal equality that it understands and includes at present not only to certain groups of persons, but rather demonstrates enclosing respect of the persons' totality that the States understand in general, it of form independent from the condition of native or foreigner that the persons have inside the States. Thus we will highlight the area of the ownership of the new social subjects that are included in this group of rights, taking in it counts the different juridical nature that the social rights possess respect of the civil and political laws, which were tending to the recognition and guarantee of the freedoms of the person humanizes inside the State.
