Decretos leyes y jurisdición constitucional. Estudios comparados.

Abstract

[ES] El presente trabajo de investigación tiene como objetivo fundamental investigar las semejanzas y diferencias existentes entre las categorías normativas que se presentan bajo la denominación general de "Decretos-leyes", también denominadas por las Constituciones: "Medidas Provisórias" (Brasil); "Disposiciones Legislativas Provisionales" (España); "Provvedimenti Provvisori con forza di legge" (Italia) y "Decretos-leis" (Portugal). En su alcance general, el estudio también pretende dar a conocer los aspectos históricos-constituyentes que condujeron a la configuración que hoy presenta este instituto en las referidas Constituciones. Además de verificar la conformación constitucional presentada actualmente en los distintos países, el estudio ha indagado más de cerca sobre el modo en que dichas normas son controladas constitucionalmente. Por otra parte, también ha sido objetivo de nuestro trabajo investigar cómo la jurisdicción constitucional se configura en estos países y la forma en que sus respectivas Cortes Constitucionales controlan dichos actos normativos. Dentro de las formas de control de constitucionalidad de las leyes, tras haber estudiado la comparación conexa entre los modelos de justicia constitucional, hibridación y circulación de los modelos, en la investigación se han destacado las influencias de los sistemas americano y europeo en la construcción del modelo brasileño de justicia constitucional. El estudio también destacó y priorizó las cuestiones relacionadas con el modo de control de constitucionalidad de las normas con rango de ley dictadas por los Gobiernos, examinando y comparando la jurisprudencia constitucional de Brasil, España e Italia. La investigación científica, de naturaleza histórico-jurídica, está fundada en fuentes bibliográficas y en documentos virtuales. Asimismo, se consultaron las principales obras jurídicas y de ciencia política empleando un método analítico-comparativo. El campo del conocimiento se inserta en el Derecho Constitucional Comparado y en las relaciones que le son conexas, de tal modo que ello permitió un amplio estudio del tema, a partir del cual se obtuvo la conclusión general de que la jurisdicción constitucional es el medio más eficaz para controlar los actos legislativos del Gobierno y por esto no se puede renunciar al control de los presupuestos constitucionales habilitantes de la edición de la legislación de urgencia. Asimismo, y para el caso específico de Brasil, se pudo concluir que la coalición que sustenta al Gobierno debe estar limitada por los principios y valores constitucionales y, de esta forma, también controlada por la jurisdicción constitucional.

[EN] This research work aims to investigate fundamental similarities and differences between the normative categories presented under the general heading of "decree-laws", also known by the constitution, "interim measures" (Brazil), "Legislative Provisions Provisional (Spain), "provvedimenti with forza di legge Provvisoria (Italy) and" decrees "leis" (Portugal). In its general scope, the study also seeks to highlight the historical aspects constituents leading to the setting that today presents the institute in the above constitutions. In addition to verifying the constitutional establishment currently presented in the various countries, the study has investigated more closely on how those rules are constitutionally controlled. On the other hand, has also been the target of our work to investigate how the constitutional court is set up in these countries and how their respective Constitutional Courts to control such legislative measures. Among the forms of control of constitutionality of laws, after studying the related comparison between models of constitutional justice, hybridization and circulation of models, research has highlighted the influence of American and European systems in building Brazilian model of constitutional justice. The survey also highlighted and prioritized issues related to the control mode of the constitutionality of the rules with the force of law issued by governments, examining and comparing the constitutional jurisprudence of Brazil, Spain and Italy. Scientific research, historical-legal, is based on literature sources and virtual documents. Also consulted the main legal literature and political science using a comparative-analytical method. The field of knowledge is embedded in comparative constitutional law and relations that are related, so that it allowed a comprehensive study of the subject, from which we obtained the general conclusion that the constitutional court is the most effective in controlling the acts of the Government and therefore can not relinquish control of budgets enabling the constitutional issue of the emergency legislation. Furthermore, for the specific case of Brazil, it was concluded that the coalition that supports the Government should be limited by constitutional principles and values ​​and, thus, also controlled by the constitutional court.
