[ES] Cuarenta años después del fin de la Dictadura Franquista, el
esclarecimiento de la Verdad, la Reparación a las víctimas de la represión
de la Dictadura y la búsqueda de la Justica se han visto obstaculizadas por
los tribunales españoles en base a la Ley de Amnistía de 1977 y a la
prescripción de los delitos cometidos.
En este trabajo se analiza la propia Ley de Amnistía, así como su
adecuación al régimen jurídico internacional. Del mismo modo, se estudia
la diferente prescriptibilidad de los delitos cometidos durante el régimen
franquista y la posibilidad de depuración de responsabilidades con
respecto a los mismos. Finalmente, se observa cuál ha sido el sentido de
las sentencias dictadas por nuestro Tribunal Supremo y las trabas puestas
a los procedimientos iniciados en el exterior amparados por el principio de
justicia universal.
[EN] Forty years after the end of the Franco dictatorship, the clarification of the
Truth, the Reparation to the victims of the repression of the Dictatorship
and the search for Justice have been hampered by the Spanish courts based
on the Amnesty Law of 1977 and the prescription of the crimes committed.
This project analyses the Amnesty Law itself, as well as its adaptation to
the international legal regime. In the same way, it is studied the different
prescription of the crimes committed during the Franco regime and the
possibility of debugging responsibilities with respect to them. Finally, it is
observed what has been the sense of the judgments handed down by our
Supreme Court and the obstacles placed on the proceedings initiated
abroad in accordance with the universal justice principle.
