[ES] Dentro del conjunto que compone la fase probatoria, hay un aspecto muy relevante, la conocida como prueba ilícita. Esta consiste en declarar nulas todas aquellas pruebas que hayan sido obtenidas vulnerando derechos fundamentales.
De esta prueba ilícita surge el desarrollo de este trabajo, y centrándose, concretamente, en la perspectiva jurisprudencial de la prueba ilícita, es decir, ver como los tribunales han ido evolucionando en su propia jurisprudencia a este respecto desde que la prueba ilícita fue introducida en nuestro ordenamiento jurídico.
Con ello se podrán ver los puntos controvertidos, y los consecuentes debates doctrinales, que ha generado esta evolución al contradecir, no solo su propia jurisprudencia, sino también la de otros tribunales.
[EN] Within the group that makes up the evidentiary phase, there is a very relevant aspect, known as illegally obtained evidence. This consists of declaring void all the evidence that has been obtained violating fundamental rights.
From this illegally obtained evidence arises the development of this work, and focusing, specifically, on the jurisprudential perspective of the illegally obtained evidence, that is, to see how the courts have evolved in their own jurisprudence in this regard since the illegally obtained evidence was introduced in our legal system.
With this, it will be possible to see the controversial points, and the consequent doctrinal debates, that this evolution has generated by contradicting, not only its own jurisprudence, but also that of other courts.
