<title>El ejercicio de la competencia judicial del Tribunal de Justicia de la Unión Europea sobre medidas restrictivas y su impacto en la evolución de la política exterior y de seguridad común de la UE</title>

<description>[ES] Las medidas restrictivas se han convertido en uno de los principales&#xd;
instrumentos utilizados por la UE en el ejercicio de la PESC. Estas son decisiones&#xd;
políticas del Consejo que se materializan en actos jurídicos sujetos al control de&#xd;
legalidad por parte del TJUE.&#xd;
Aunque el artículo 275 del TFUE establece una cláusula «carve-out», de exclusión&#xd;
de competencia en materia PESC, en un complejo reenvío al artículo 263.4 TFUE&#xd;
se reconoce una excepción de la excepción a través de una cláusula «claw-back»,&#xd;
que permite el control de legalidad de las decisiones por las que se establecen&#xd;
medidas restrictivas frente a personas físicas o jurídicas. Se consolida de esta&#xd;
manera un perfeccionamiento progresivo de la PESC, al someter al escrutinio de&#xd;
los jueces de Luxemburgo decisiones sobre las que el Consejo goza de un alto&#xd;
grado de discrecionalidad.&#xd;
Fruto de la intensa actividad judicial, incrementada exponencialmente en los&#xd;
últimos años, se ha ido formando una amplia jurisprudencia referida tanto a los&#xd;
aspectos procesales (competencia sobre diferentes tipos de recursos, locus standi,&#xd;
ejercicio de la función jurisdiccional, entre otros), como a los elementos formales&#xd;
y materiales de las medidas restrictivas en sí. En consecuencia, el contenido de&#xd;
estos fallos jurisdiccionales ha contribuido de forma clara a moldear el diseño de&#xd;
las medidas restrictivas por parte del Consejo.&#xd;
Este trabajo de investigación tiene como objetivo determinar el valor e influencia&#xd;
de esta jurisprudencia, así como su impacto en la evolución de la PESC, a través&#xd;
de un análisis sistemático y completo de la misma.&#xd;
[EN] Restrictive measures have become one of the primary tools employed by&#xd;
the EU in the exercise of the CFSP. These are political decisions of the Council&#xd;
that are materialized into legal acts subject to the legality review by the CJEU. Although Article 275 of the TFEU establishes a carve-out clause, excluding&#xd;
jurisdiction in CFSP matters, a complex referral to Article 263.4 TFEU poses an&#xd;
exception to the original exception through a claw-back clause, thus allowing for&#xd;
the legality review of decisions that adopt restrictive measures against natural or&#xd;
legal persons. This consolidates a progressive refinement of the CFSP, by&#xd;
allowing decisions, over which the Council enjoys a high degree of discretion, to&#xd;
be under the scrutiny of the judges in Luxembourg.&#xd;
As a result of intensive judicial activity, which has increased exponentially in&#xd;
recent years, a vast case-law corpus has been developed concerning both&#xd;
procedural aspects (jurisdiction over different types of actions, locus standi,&#xd;
fundamental elements of the judges´ activity, among others) and the formal and&#xd;
material elements of the restrictive measures themselves. Consequently, the&#xd;
content of these judicial rulings has clearly contributed to shaping the design of&#xd;
restrictive measures by the Council.&#xd;
This research seeks to determine the value and influence of such case-law, as well&#xd;
as its impact on the evolution of the CFSP, through a systematic and&#xd;
comprehensive analysis thereof.</description>
