[ES]A pesar de los medios legales y de ayuda social existentes hoy en día, la violencia de género sigue siendo un problema muy enraizado en la sociedad española. La dificultad de su erradicación se encuentra en que la violencia de género debe prevenirse, tratarse y sancionarse desde un enfoque multidisciplinar. La tutela judicial se presenta como una solución para las víctimas de violencia de género pero, desgraciadamente, el porcentaje de mujeres que acuden a denunciar sigue siendo pequeño. La inhibición de denunciar tiene su origen en diversas causas y provoca que no pueda ponerse en marcha la maquinaria judicial. Además, aunque se haya presentado la denuncia, existen otros problemas que se pueden dar en el curso del proceso (la retirada de misma, la dispensa del art. 416 LECrim, la imposibilidad de probar los hechos, etc.). Por otro lado, todavía existen numerosos mitos que rodean al fenómeno de violencia de género en general y a la denuncia de violencia de género en particular. Nos centraremos en estos últimos.
[EN]Despite of the legal and social aid means that exist nowadays, gender violence continues to be a very deeply rooted problem in the Spanish society. The difficulty of its eradication lies in the fact that gender violence must be prevented, treated and sanctioned from a multidisciplinary approach. Judicial action is without a doubt a solution for those women suffering from gender violence, but unfortunately the percentage of women that submit a complaint is still low.
Under-reporting of gender violence stems from diverse causes and avoids the judicial machinery to start functioning. Furthermore, even when the complaint is filled, there exist other problems that can arise during the proceedings (the withdrawal of the complaint, the right not to testify of the victim under article 416 of the Spanish Criminal Procedure Law, the inability to prove the facts, etc.). Additionally, many myths still surround gender violence cases in general and the complaints of those crimes in particular. The essay focuses in these myths about the complaints.
