[ES] La inviolabilidad del domicilio no es un derecho fundamental absoluto, sino que cede frente a los intereses de la investigación criminal en aquellos casos en los que la ley prevé que puede practicarse la diligencia de entrada y registro. Los casos en los que puede practicarse esta diligencia de investigación vienen establecidos por la Constitución y desarrollados por la Ley de Enjuiciamiento Criminal y son: cuando el titular del domicilio otorga su consentimiento, cuando existe una resolución judicial autorizando la entrada y registro y cuando exista un supuestos de flagrancia delictiva.
A lo largo de este trabajo nos centraremos en el estudio de esta diligencia de investigación, de los supuestos en los que puede practicarse, de la forma en la que debe llevarse a cabo en la práctica y de su valor procesal, haciendo también referencia al derecho a la inviolabilidad del domicilio y analizando qué se entiende por domicilio a efectos del art. 18.2 CE.
[EN] The inviolability of domicile is not an absolute right. This constitutional right yields to criminal investigation’s purposes when the proceeding of entry and registration address is permitted by Law. According to article 18.2 of the Spanish Constitution and to Spanish Criminal Law, there are three exceptions in where this criminal proceeding can be carried out. These cases are: when the owner of the domicile expresses consent, when there is a court order or when someone is caught in flagrante delicto.
In this essay, we will focus on the proceeding of entry and registration, the cases when this criminal proceeding can be carried out and the procedural law ruling the process. In addition, the inviolability of domicile and the notion of domicile according to the article 18.2 of the Spanish Constitution will be also examined
