Protección a la mujer foránea en el sistema nacional de salud español: evolución y análisis crítico

Abstract

[ES] El derecho a la protección de la salud es un principio rector de la política social y económica recogido en el artículo 43 de la Constitución Española de 1978, que establece la garantía del Estado en la conquista de este derecho. Además, este derecho a la salud se halla consagrado en otras normas jurídicas europeas y de régimen interno estatal, autonómico y local, regulando todas las acciones que son necesarias para hacerlo efectivo y garantizando la universalidad de la asistencia y la equidad en salud, dos principios rectores del sistema sanitario español que constituyen también los pilares de este trabajo de investigación, cuyo objetivo principal será analizar la protección de la salud de una población o colectivo, pero bajo dos premisas fundamentales: la variable sexo-mujer sobre el carácter foráneo de este colectivo, vinculando la situación de salud de las mujeres respecto a los varones, y viendo como influye la variable inmigración en dicho proceso. Esta variable sexo-género representa un factor importante a tener en cuenta en el estudio del nivel de bienestar tanto sanitario como social, que hasta hace poco tiempo pasaba desapercibido dando lugar a la invisibilidad de las mujeres desde un punto de vista sanitario, aspecto que se aborda en esta investigación desde la perspectiva del profesional de Enfermería y su actuación hospitalaria. Pero también se deben tener en cuenta las condiciones que presenta o sufre la población extranjera en nuestro país vinculadas al proceso migratorio y/o a la adaptación sociocultural a la que se ven sometidos, y cuya influencia se ve reflejada en el nivel de salud o enfermedad de estas personas, y especialmente en el colectivo de mujeres

[EN] The right to health protection is a guiding principle of social and economic policy enshrined in Article 43 of the Spanish Constitution of 1978, which establishes the State guarantee in the conquest of this right. In addition, the right to health is enshrined in European and other legal rules of procedure state, regional and local levels, regulating all actions that are necessary to make it effective and guaranteeing the universality of health and health equity, two principles guiding the Spanish healthcare system which also constitute the pillars of this research, whose main objective is to analyze the protection of the health of a population or group, but under two fundamental premises: the sex variable-foreign woman on the character of this group linking health status of women compared to men, and seeing how immigration affects the variable in this process. This variable-gender sex is an important factor to consider in the study of the level of both health and social welfare, which until recently unnoticed leading to the invisibility of women from a health point of view, something that is in this research from the perspective of professional nursing and hospital performance.
