Análisis crítico sobre la prohibición legal de la maternidad subrogada en España

Abstract

[ES] La celebración de contratos de maternidad subrogada representa un fenómeno creciente en la actualidad. Tales contratos son nulos de pleno derecho en nuestro Ordenamiento jurídico, lo que hace que los ciudadanos españoles acudan a otros Estados en que sí están permitidos, los celebren y regresen a España con niños nacidos mediante este tipo de procedimientos. El trabajo tiene por objeto estudiar los problemas que se plantean cuando estos padres comitentes pretenden inscribir en el Registro civil español la filiación de esos niños, la cual da lugar a diversos problemas en el ámbito estatal, pues el interés superior del menor puede verse vulnerado si su filiación queda indeterminada

[EN] Nowadays surrogacy contracts are an increasing event but they are void under law in our legal system. This is the reason why a lot of Spanish citizens go to other States in which surrogacy is allowed and then they go back to Spain with babies born with this method. The aim of this study is to examine the problems that arise in the sphere of the State when those parents claim to register their sons in the Spanish Civil Registry since, if the filiation remains indeterminate, minors’ interest will be damaged.
