Fiscal General del Estado: una extensión del poder ejecutivo

Abstract

[ES] El Ministerio Público y el Fiscal General del Estado se han visto sometidos a debate desde el comienzo de la democracia en 1978, en grande medida por la elección de éste y su relación con el Poder Ejecutivo. Tras el nombramiento en febrero de 2020 de la que fuera exministra de Justicia como nueva Fiscal General del Estado, Dolores Delgado García, esta discusión se ha visto intensificada en el plano jurídico y social. Mediante el análisis del sistema español y de otros estados, daremos a conocer sobre las relaciones Ministerio Público-Poder Ejecutivo y si, de alguna manera, se puede dotar de mayor independencia a este órgano o, por el contrario, esta vinculación es idiosincrática a éstos.

[EN] The Public Ministry and the State Attorney General have been subject to debate since the beginning of democracy in 1978, largely due to their election and their relationship with the Executive Power. Behind the appointment in February 2020 of the former Minister of Justice as the new State Attorney General, Dolores Delgado García, this discussion has intensified on the legal and social level. Through the analysis of the Spanish system and other states, we will make known about the Public Ministry-Executive Power relations and if, in some way, this body can be given greater independence or, on the contrary, this link is idiosyncratic to them.
