Derechos y garantías procesales penales fundamentales una lectura en clave tecnológica

Abstract

[ES]Realizar una valoración inicial sobre el acomodo de la tecnología disruptiva con los derechos fundamentales y garantías constitucionales implica analizar la repercusión de la posible utilización de elementos tecnológicos de última generación (inteligencia artificial) en funciones asistenciales de la labor jurisdiccional. El binomio proceso judicial e inteligencia artificial es una realidad que debe conciliarse desde tres premisas imprescindibles: normal legal, jurisdiccionalidad y respeto a los derechos fundamentales. Sin duda, el hecho de que la aplicación de la inteligencia artificial se sostenga, como uno de sus grandes principios, por la necesidad de control por humano, garantiza que el órgano jurisdiccional sea el garante de la legalidad y constitucionalidad de la utilización de soluciones de inteligencia artificial en funciones auxiliares en la actividad procesal sin que el justiciable vea afectados derechos fundamentales como la presunción de inocencia, el derecho de defensa o el derecho a la tutela judicial efectiva, que, a su vez, deben ser interpretados y adaptados a la realidad tecnológica actual.[EN]Carrying out an initial assessment of the accommodation of disruptive technology with fundamental rights and constitutional guarantees implies analyzing the impact of the possible use of cutting-edge technological elements (artificial intelligence) in auxiliary tasks of jurisdictional work. The binomial judicial process and artificial intelligence is a reality that must be reconciled from three essential premises: legal normality, jurisdictionality and respect for fundamental rights. Without a doubt, the fact that the application of artificial intelligence is supported, as one of its main principles, by the need for human control (human in commad), guarantees that the jurisdictional body is the guarantor of the legality and constitutionality of the use of security solutions.Artificial intelligence in auxiliary functions in the procedural activity without affecting the defendant’s fundamental rights such as the presumption of innocence, the right of defense or the right to effective judicial protection, which, in turn, must be interpreted and adapted to reality current technology.
