Public interest and the principle of opportunity in the prosecution of crimes committed by minors in cases of sexual violence in Spain

Abstract

[EN] The aim of this chapter is to analyse the circumstances that led to the introduction of the principle of opportunity in juvenile criminal proceedings as opposed to the principles of officiality and legality that generally govern the Spanish criminal procedural model, and how the validity of this principle has been affected by the approval of Organic Law 10/2022, of 6 September, on the Comprehensive Guarantee of Sexual Freedom, in relation to sexual and gendered violence committed by minors. [ES] El objetivo de este capítulo es analizar las circunstancias que llevaron a la introducción del principio de oportunidad en el proceso penal de menores, frente a los principios de oficialidad y legalidad que rigen, en general, el modelo procesal penal español, y cómo la aprobación de la Ley Orgánica 10/2022, de 6 de septiembre, de garantía integral de la libertad sexual, ha afectado a la validez de este principio en relación con la violencia sexual y de género cometida por menores.
