Resumen
[ES] La hipoteca inversa se regula por primera vez en nuestro ordenamiento en la Ley 41/2007, de 7 de diciembre. Pero la aparición de esta figura en el mercado hipotecario comienza años antes, cuando algunas entidades financieras comienzan a ofrecer en España hipotecas inversas. Esta figura ya gozaba de una cierta tipicidad social en nuestro país antes de concretarse en el Derecho Positivo. Igualmente en el resto de Europa, legislativamente se comienzan a implantar estas hipotecas ya establecidas en los países anglosajones. Desde los años 60 esta hipoteca tanto en EEUU como Reino Unido, forma parte de los negocios jurídicos destinados a hacer líquido el valor del inmueble, bajo diferentes modelos contractuales. Podríamos definirla la hipoteca inversa como el derecho hipotecario que se constituye sobre la vivienda habitual del solicitante, persona física de edad igual o superior a 65 años, o afectada de dependencia, para garantizar un préstamo o crédito, cuya restitución sólo podrá ser exigida al fallecimiento del solicitante, y cuya finalidad es la obtención de una renta periódica o capital único hasta un máximo determinado por un porcentaje del valor de tasación en el momento de la constitución. La hipoteca inversa ofrece otras las ventajas frente a otros contratos destinados a conseguir ingresos utilizando la vivienda, como el hecho de permitir al solicitante no abandonar su hogar, tampoco supone la pérdida del inmueble por tener que asumir una venta o una cesión de la posesión, o qué únicamente se va a consumir el patrimonio necesario para atender las necesidades del solicitante, hasta el fallecimiento del deudor, y el hecho de que sea un contrato formalizado fuera del entorno familiar, donde la contraparte va a ser una entidad financiera sometida a una serie de requisitos, cargas y controles legales. Además, esta hipoteca rompe con muchos principios del Derecho Hipotecario español: no sigue el sistema de responsabilidad universal, tal y como la conocemos en el sistema hipotecario; admite excepciones ex lege, a los principios hipotecarios, delimitando un nuevo derecho real de hipoteca, y por tanto, merece este estudio pormenorizado [EN] The reverse mortgage is regulated for the first time in our system by the Law 41/2007, of December 7. But the appearance of this figure in the mortgage market began years ago, when some financial institutions in Spain start offering reverse mortgages. This figure already enjoyed a certain social criminality in our country before concluding in positive law. Also in the rest of Europe, legislatively begin to implement these mortgages already established in Anglo-Saxon countries. Since the 60s this mortgage in the U.S. and United Kingdom, as part of legal transactions designed to make liquid the value of the property, under different contractual models. Reverse mortgage might define as the mortgage that is right on the applicant's residence, person aged less than 65 years, or affected unit, to guarantee a loan or credit, for which restitution may be imposed only to the death the applicant, and whose purpose is to obtain a regular income or a maximum single capital determined by a percentage of the appraised value at the time of the constitution. A reverse mortgage offers other advantages over other contracts to earn income using housing as the fact of allowing the applicant does not leave his home, nor does it imply the loss of the property by having to take a sale or transfer of possession, or what is to be consumed only the assets needed to meet the needs of the applicant, until the death of the debtor, and the fact that it is a contract entered into outside the home, where the counterparty is going to be a financial institution subject to a series requirements, charges and legal controls. Also, this mortgage breaks many early Spanish Mortgage Law: not following the system of universal responsibility, as we know in the mortgage system, supports exceptions ex lege, the mortgage early, defining a new property right mortgage, and therefore deserves detailed study
