Las técnicas de reproducción asistida: especial consideración por la maternidad por sustitución en el contexto ibérico

Abstract

[ES]Pretendemos retomar la investigación sobre Procreación Médicamente Asistida con el propósito fundamental de promover una aproximación más estrecha entre Portugal y España procurando, en esta materia, analizar las cuestiones jurídicas más actuales y controvertidas, para que se logre el objetivo propuesto de armonización legal, así como actualizar el estudio anterior.

Además, nos centramos en la investigación de la maternidad por sustitución como uno de los problemas más controvertidos de todo el proceso de la Procreación Médicamente Asistida, no solo a nivel jurídico, sino también a nivel bioético, moral y social.

Las propias leyes reguladoras de la Procreación Médicamente Asistida (Portuguesa y Española) consagran determinadas formas de superar o eludir la infertilidad de la pareja, olvidándose de que, en algunas circunstancias, la infertilidad no se puede remediar mediante técnicas médicas, sobre todo cuando la supuesta mujer de recepción no puede soportar un embarazo hasta el final.

[EN]We intend to resume the Medically Assisted Procreation research with the ultimate aim of promoting closer approximation between Portugal and Spain seeking , in this field, analyzing the most current and controversial legal issues , so that the proposed legal harmonization goal is achieved and update the previous study.

In addition , we focus on the investigation of motherhood substitution as one of the most controversial issues of the whole process of Medically Assisted Procreation , not only legally, but also to bioethical , moral and social level .

Own laws regulating Medically Assisted Procreation ( Portuguese and Spanish ) enshrine certain ways to overcome or circumvent infertility of the couple , forgetting that , in some circumstances , infertility can not be remedied through medical techniques , especially when the alleged desk woman can not support a pregnancy to term .
