Estudio sobre la figura del contrato de comodato y del precario: aplicación a la cesión gratuita de vivienda familiar

Abstract

[ES] España, actualmente está viviendo una situación de crisis económica que impide a un gran número de parejas adquirir un inmueble o alquilarlo, por eso, es frecuente que los padres cuando uno de sus hijos decide contraer matrimonio, preste a éste y a su cónyuge un inmueble que haga de vivienda familiar. Nos encontramos, en estos casos, en el supuesto de que la vivienda que venía utilizando la familia no es propiedad de ninguno de los cónyuges. Mientras que el matrimonio conviva con normalidad no habrá ningún problema, pero, en el momento en que se produce la crisis matrimonial y, por sentencia judicial de separación o divorcio, se adjudica dicha vivienda a aquella persona con la que el propietario ya no tiene ningún vínculo de afectividad, dicho propietario, normalmente decide ejercer la acción de deshaucio por precario para poder recuperar la vivienda. Ante estas situaciones es común que se acuda a los Tribunales para dirimir la controversia, ya que el propietario alega que la persona que reside en su inmueble es un precario y la persona, a la cual le fue adjudicada la vivienda por sentencia dictada en un procedimiento matrimonial, alega que se encuentra ante una situación de contrato de comodato. En este trabajo se ha querido estudiar esta situación y, es por ello que tratamos en profundidad, en primer lugar, ambas figuras, el contrato de comodato, y el precario para finalizar con el estudio de la cesión gratuita de vivienda familiar, tras la crisis matrimonial, ¿comodato o precario?

In this work, we have wanted to study this situation, and that is why we are dealing with in depth, in the first place, both figures, the gratuitous bailment contract, and the precarious to finish up with the study of the transfer free of family housing, after the crisis in their marriage, gratuitous bailment or precarious?
