Las lagunas del Derecho

Abstract

[ES] Las lagunas del derecho son un concepto familiar en la esfera legal, pero al mismo tiempo se trata de unas grandes desconocidas para la sociedad. Por ello, lo que el trabajo pretende es mostrar dicho tema desde su comienzo, sin dejar de lado teorías de grandes autores de la filosofía del derecho intentando ofrecer al lector una definición lo más clara posible dada la complejidad del concepto, así como también un recorrido sobre el problema de las mismas y haciendo hincapié para ayudar así a una global compresión de las diferentes clases de lagunas existentes en el ordenamiento jurídico y la clasificación de las mismas. La importancia de este tema, radica en la necesidad que tiene el sistema jurídico de presentarse como un ente que se considere lo más pleno posible, coherente y unitario a la vez, convirtiéndose estos rasgos en imprescindibles para el ordenamiento jurídico, viéndose afectado no solo con la presencia de las lagunas en la ley, sino además con el silencio sobre la forma de solucionarlas.

[EN] The loopholes of law are a familiar concept in the legal sphere, but at the same time they are great strangers to society. Therefore, what the paper intends is to show the topic from the beginning, without leaving aside theories of great authors of the philosophy of law, trying to offer to the reader a definition as clear as possible, taking in account the complexity of the concept, as well as a journey on the problem and emphasizing to help in this way a global understanding of the different kinds of gaps existing in the legal order and the classification of them. The importance of this subject lies in the need for the legal system to present itself as a body that is considered as complete as possible, coherent and unitary at the same time, making these features essential for the legal order. Affected not only by the presence of loopholes in the law, but also with the silence on how to solve them.
