Resumen
[ES] Las técnicas de reproducción humana asistida permiten que parejas o individuos que
desean tener un hijo, obtengan la oportunidad de conseguirlo a través del procedimiento
denominado como “gestación por sustitución”. Este proceso va a consistir en que una
mujer distinta a la que va a ser la madre legal del nacido geste al bebé y se ocupe de traerlo
al mundo. Esta práctica cada vez es más demandada, siendo utilizada en muchas ocasiones
como la solución de último recurso para conseguir ser padres/madres. En España, estos
contratos son nulos de pleno derecho, en este sentido, la filiación va a corresponder a los
padres biológicos según el artículo 10 de la Ley 14/2006, de 26 de mayo, sobre Técnicas
de Reproducción Humana Asistida. Sin embargo, va a ser posible poder constituir la
filiación de un niño nacido mediante gestación subrogada en un país donde sí permitan
estos contratos a favor de los padres comitentes, siempre y cuando se cumpla una serie de
requisitos establecidos en la Ley. Mi trabajo tiene por objeto el poder mostrar cómo es
posible que el bebé nacido por maternidad subrogada, pueda ser inscrito en el Registro
Civil Español, pese a ser contratos nulos por nuestro ordenamiento jurídico, abordando las
sentencias más relevantes y destacadas en esta materia. [EN] Assisted human reproduction techniques allow individuals who wish to have a child to
obtain the opportunity to obtain through the so-called "gestation by substitution"
procedure. This process is going to consist in that a woman other than the one who goes to
the legal mother of the born gestures the baby and takes care of the world of bringing it.
This practice is more and more demanded, being used in many occasions as the solution
of last resort to obtain the fathers / mothers. In Spain, these contracts are null and void, in
this sense, the filiation will correspond to the biological parents according to article 10 of
Law 14/2006, of May 26, on Assisted Human Reproduction Techniques. However, it is
possible that the constitution of the filiation of a child born through the gestation of a
country in a country where it does allow contracts in favor of the principals parents,
provided that a series of requirements established in the Law My work aims to show how
it is possible that the baby born to surrogate motherhood, can be registered in the Spanish
Civil Registry, despite being null contracts by our legal system, addressing the most
relevant and prominent sentences in this matter .
