Resumen
[ES] El presente trabajo de investigación trata sobre uno de los temas más controvertidos del proceso penal: las medidas cautelares. Tradicionalmente se ha tenido el sinónimo de prisión con el de pena, o anticipación de la pena, o vulneración al principio de presunción de inocencia, y por otro lado la tutela de derechos de la víctima. Los derechos y garantías de las partes no deben ser contradictorios ni colisionarse, ya que por un lado deben existir mecanismos eficaces para proteger a la víctima y/o a la sociedad, y por otro, no prejuzgar a las personas por la imputación de un hecho.
La investigación del delito es de orden público y no debe ni puede detenerse, pero los derechos de las personas a su libertad e intimidad deben protegerse sobre cualquier imperio del Estado, de manera progresiva. Al final se enumeran una serie de discusiones tanto teóricas como prácticas que deben atenderse al momento de aplicar las medidas cautelares en el proceso, y siempre tomar en cuenta tanto a la dogmática penal como a los derechos humanos, para darle contenido al proceso.
