Resumen
[ES] El presente trabajo busca, con la metodología racional-deductiva, un análisis normativo,
estableciendo criterios desde la teoría de las normas hacia las nuevas necesidades de la
Sociedad del Riesgo para ubicar las leyes penales en blanco en la realidad del Derecho penal
moderno, a menudo con sus inevitables roces con el principio de legalidad y sus corolarios.
En la actual sociedad post-moderna, con nuevos riesgos y una irrefrenable inseguridad social,
el discurso legislativo ha sufrido un vertiginoso cambio de paradigma, incluso de
justificación, en aras de proporcionar al seno social un abanico de posibilidades de control, a
menudo por intermedio del Derecho penal. Lo que otrora no se anclaba en la tutela penal, aún
más ante un pensamiento liberal y proclive a la libertad personal, ahora surge imbricado en
una cada vez mayor necesidad de protección por la ultima ratio del poder intervencionista
estatal. Las nuevas necesidades han consagrado nuevos bienes jurídicos, de difícil
contextualización en el seno del tradicional Derecho penal liberal, lo que ha hecho con que
los aplicadores del derecho y los legisladores busquen nuevas fórmulas de garantizar la
seguridad social nunca antes tan necesitada de protección. En ello, han emergido las técnicas
de reenvío, netamente en las leyes penales en blanco, generando escollos para su adaptación
sistémica en el seno del viejo Derecho penal. Y dichos escollos merecen detenido análisis
dogmático para asegurar el control exigido por un Estado social, empero, sin desdibujar los
límites garantistas infranqueables de un Estado de Derecho. [EN] This paper aims, in a hypothetic-deductive methodology, a normative analysis,
establishing criteria from the theory of norms to the new needs of the Risk Society to locate
the unregulated criminal norms on the reality of modern criminal law, often with inevitable
clashes with the legal principles and their corollaries. In today's post-modern society, with
new risks and an irrepressible social insecurity, the legislative discourse has undergone a
rapid paradigm shift, even in its justification, in order to provide the social claims with a
range of possibilities of control, often through criminal law. What once was anchored not in
criminal custody, even before a liberal and prone to personal freedom thought, now comes
embedded in a growing need for protection by the ultima ratio of state interventionist power.
The new requirements have consecrated new legal rights, making difficult the
contextualization within the traditional liberal criminal law, which has made the law
enforcers and legislators to search for new ways of ensuring social security, as it has never
happened before in need of protection. It has emerged forwarding techniques, purely in
criminal laws, spawning reefs for systemic adaptation within the old criminal law. And these
pitfalls deserve a careful dogmatic analysis to ensure the effectiveness require by a welfare
state, without, however, misalign the insurmountable limits of the rule of law.
