Resumen
[ES] En el contexto de un Estado constitucional y democrático de derecho, se ha planteado un nuevo paradigma en la comprensión del rol que le corresponde a la judicatura. Particularmente relevante resulta ser la función de garantía de los derechos fundamentales de las personas, que compete a los jueces. Para cumplir adecuadamente este rol, en los países miembros del Pacto de San José de Costa Rica, se ha empleado la técnica del control de convencionalidad, como una manera de confrontar el ordenamiento jurídico interno con las normas de la Convención Americana de Derechos Humanos.
Esta forma de desempeñar la actividad jurisdiccional, ha sido objeto de múltiples críticas. Primeramente, no se reconoce su fundamento normativo y, consecuentemente, la obligatoriedad de llevar a cabo este control de convencionalidad en el plano nacional. Además, se ve en esta labor del juez nacional, más que el acatamiento irrestricto al ordenamiento jurídico, una agenda política propia de los jueces para resolver los asuntos que les someten a su conocimiento, prescindiendo de la ley y siendo displicentes con las normas generadas por los órganos democráticamente electos. Parte de este conflicto se da por la tradición formalista de la enseñanza del derecho y la práctica judicial asentada por años, unida a un cierto aislamiento de Chile en el proceso de internacionalización de los derechos fundamentales. Sin embargo, desechar la importante labor en materia de reconocimiento, promoción y protección de los derechos humanos que compete a todos los integrantes del aparato Estatal, puede significar una grave vulneración a los derechos de las personas y una condena internacional para el Estado.
