Resumen
[ES] El contrato de leasing supone la cesión del uso de un bien empresarial mediante precio y durante un plazo de tiempo, con la posibilidad llegado su término de poder ser adquirido. El progresivo desarrollo de la actividad productiva y de la comercialización de bienes y servicios ha propiciado la necesidad de crear nuevas técnicas jurídicas que faciliten las relaciones de intercambio entre los distintos operadores que interactúan en el tráfico económico, dando lugar de esta forma a nuevas figuras alternativas como el contrato de arrendamiento financiero. Sin embargo, la carencia sustantiva del mismo ha propiciado varias discrepancias en cuanto a su naturaleza y contenido, por lo que su estudio se centra en el análisis de su práctica (a partir de la jurisprudencia que ha generado) y encuadre en nuestro ordenamiento.
Se analiza igualmente el tratamiento jurídico del contrato de leasing en el ámbito del derecho concursal, examinándose más detenidamente la regulación prevista en la Ley Concursal para la calificación de las cuotas del leasing posteriores al concurso así como la extensión y alcance del privilegio especial. [EN] The leasing contract involves the transfer of the use of a business asset for a price and for a period of time, with the possibility of being able to acquire it at the end. The progressive development of production activity and the marketing of goods and services have led to the need to create new legal techniques to facilitate relations of exchange between the different operators who interact in economic traffic, thus giving rise to new alternative figures such as the leasing contract. However, the substantive lack of this has led to several discrepancies in terms of its nature and content, so its study focuses on the analysis of its practice (based on the jurisprudence it has generated) and its place in our system.
It also analyses the legal treatment of the leasing contract in the field of insolvency law, examining in greater detail the regulation provided for in the Insolvency Law for the qualification of the leasing payments after the insolvency proceedings, as well as the extension and scope of the special privilege.
