Resumen de tesis. Cooperación procesal internacional en la lucha contra la criminalidad transfronteriza: especial referencia al cibercrimen y al terrorismo

Abstract

[ES] La tesis realiza un exhaustivo análisis de la relación de los TIC con el Derecho Procesal y Penal sobre la cooperación en la investigación de la delincuencia transfronteriza. La cooperación a nivel internacional, regional europea y nacional en la lucha contra un delito cada vez más tecnológico y global es un deber y no una facultad. Para ello en nuestro estudio se pone la atención en la regulación de la Red con medidas que mejoran nuestra higiene cibernética, con medidas legales por parte de las instituciones para limitar una delincuencia que tiene las TIC como medio y como objeto de su actividad. Posteriormente la investigación estudia y analiza la trayectoria del desarrollo normativo a nivel internacional con UN y regional con la UE en la conceptualización y regulación penal del terrorismo y la creación de agencias e instrumentos que ayudan en la investigación y enjuiciamiento de la delincuencia transfronteriza como los Magistrados de Enlace, Eurojust, Equipos conjuntos de investigación, Europol con la EC3 y J-CAT y otras iniciativas como la Orden Europea de Investigación como pasos cruciales para la creación de un espacio de libertad, seguridad y justicia.

Atenderemos la necesidad de adaptación del sistema penal y procesal con diligencias de investigación tecnológica en la investigación y enjuiciamiento de una delincuencia que tiene carácter transfronterizo

[EN] The thesis carries out an exhaustive analysis of the relationship of ICT with Procedural and Criminal Law on cooperation in the investigation of cross-border crime. Cooperation at the international, regional, European and national level in the fight against an increasingly technological and global crime is a duty and not a choice. For this, our study focuses on the regulation of the Network with measures that improve our cybernetic hygiene, with legal measures by the institutions to limit a crime that uses ICT as a tool and as an objective of its activity. Subsequently, the investigation studies and analyses the trajectory of normative development at the international level with the UN and regionally with the EU in the conceptualization and criminal regulation of terrorism and the creation of agencies and instruments that help in the investigation and prosecution of cross-border crime such as Liaison Magistrates, Eurojust, Joint Investigation Teams, Europol with EC3 and J-CAT and other initiatives such as the European Investigation Order as crucial steps in the creation of an area of freedom, security and justice.

We will address the need to adapt the criminal and procedural system with technological investigation diligence procedures in the investigation and prosecution of a crime that has a cross-border nature.
