Resumen
[ES]El Derecho Administrativo es un producto cultural que surge de la necesidad de racionalizar el ejercicio del poder, con el fin de comprometerse con la libertad, la igualdad y la fraternidad de los seres humanos. La revolución francesa fue un ejemplo de este compromiso. Antes del Derecho Administrativo, el poder público era expuesto al capricho y a la voluntad del Soberano en el Antiguo Régimen. Sin embargo, siempre ha existido la necesidad de organizar los intereses colectivos de acuerdo con el derecho, aunque no siempre se haya logrado de la mejor manera.
En la actualidad, el Derecho Administrativo ha cobrado una gran importancia en el inicio de este nuevo siglo, debido a la amenaza que representa el fundamentalismo económico y la lógica del poder por el poder, que ponen en peligro las nobles aspiraciones de justicia y el bienestar general en nombre del beneficio empresarial, el dominio político y la utilidad. Frente a esta tendencia a sacrificar el interés general en favor de consideraciones parciales, el nuevo Derecho Administrativo se presenta como un obstáculo contra cualquier atentado al bienestar integral de la población y para proteger el funcionamiento objetivo del poder público a través de la senda del derecho. El fundamento teórico de esta rama del Derecho Público se basa en la esencia, la naturaleza y el alma de un Ordenamiento jurídico construido para servir al interés general.
